Our Terms
These Terms and Conditions apply to orders submitted by you to FUJIFILM UK Limited over the phone or online for products available from the FUJIFILM Shop and Service & Support section ("the store") of the (shop.fujifilm.co.uk) web site. "The store" is only intended for use by people resident in the United Kingdom and Republic of Ireland. By placing an order through "the store", you warrant that:
(a) you are legally capable of entering into binding contracts;
(b) you are at least 18 years old;
(c) you are resident in the United Kingdom or Republic of Ireland; and
(d) you are accessing “the store” from that country.
Prices, Postage & Packing
Prices and postage & packing charges shall be as specified in "the store", as determined when ordering over the phone or online. Our prices in "the store" include any applicable value added taxes. We reserve the right to change prices published in "the store" at any time.
Payment
Payment for products ordered over the telephone or online must be made by credit or debit card. We cannot accept Solo, Electron or American Express cards. Products ordered shall not be despatched until authorisation of the credit card payment has been made.
Credit/Debit card security online
We take security and customer service very seriously and appreciate the trust placed in us by all of our customers when giving us their card details. For this reason, we have implemented a fully hosted payment solution provided by Datacash Group PLC.
Datacash Group PLC are compliant to the highest level (level 1) of the PCI-DSS (Payment Card Industries Data Security Standard). Datacash collects, processes and stores the card details on their system at the time of order. Card details are stored with Datacash for 6 months allowing us to quickly issue refunds where necessary. FUJIFILM UK Limited employees have no access to any sensitive customer information, including card details held within the Datacash systems. Our employees use reference numbers, supplied to us by Datacash at the time of order, to conduct any refunds or cancellations.
At no time does FUJIFILM UK Limited store or transmit any sensitive card details.

Accepting orders online
When you place an order online we will treat it as an offer to buy. We will send you a confirmation e-mail with your order number, at which point we make a legal contract with you. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will e-mail you as soon as we can to let you know.
When you order you will have an opportunity to check the details and correct any input errors.
In deciding whether to accept your order, we may use the information you have given to us, or we already hold about you, or which we receive from any enquiry we may make with our credit checking company to confirm your identity. The credit checking company will check any details we disclose to them against any database (public or private) to which they have access and will keep a record of that check. The credit checking company will also retain this information and may use it in the future to assist other companies with identity verification. This assists us to protect you and us from fraudulent transactions. If we decline your offer on security grounds we may contact you to seek an alternative payment method.
The contract created between you and us by our acceptance of your order is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of such contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of such contract, or any of our rights or obligations arising under it, at any time during the term of such contract.
Availability
While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product or refund you the price paid for such goods as soon as possible and in any case within 30 days. In the case of refurbished cameras, substitution of product will not occur.
Telephone Orders
All orders are subject to acceptance by us.
Cancellation of Order
We reserve the right to cancel any accepted order prior to delivery, at our discretion (whether or not your credit card has already been charged), in case of any material errors in connection with your order, the price or other conditions published in "the store" relevant for your order. If your credit card has already been charged and your order is cancelled, we will immediately upon confirmation issue an appropriate credit to your credit card account.
Delivery
Standard Delivery
All orders will be dispatched the same or next working day. Orders over £50 will be dispatched by CityLink. Orders under £50 and all SuperWarranty orders will be dispatched by either Royal Mail delivery service or TNT.
Standard UK Delivery costs between £2.99 and £8.99, this is based on the value of the order.
Highlands & Islands, Republic of Ireland delivery costs between £4.99 for orders under £50 and £12.49 for orders over £50.
Next Day Delivery
Next Day Delivery orders must be received before 2:00pm to be dispatched the same day. Orders received after 2:00pm will be dispatched the following working day. Deliveries can ONLY be made on working days; we're currently unable to offer weekend deliveries. Next day orders received before 2.00pm on a Friday will be delivered the following Monday. Next day delivery orders are sent by City Link Express Parcel Delivery.
Next Day Delivery cost is fixed at £10.00
We regret we are unable to deliver to BFPO addresses.
Next Day Delivery is NOT available to the Highlands & Islands, Northern Ireland and Republic of Ireland, Channel Islands
Title of goods
Title of all products ordered passes to you upon the full payment or delivery of products. Risk of loss and damage pass to you upon delivery.
Promotional Codes
Promotional codes cannot be used in conjunction with any existing offers contained within the store. If this was to happen, the best discount by value would be offered. Traded in cameras from the service and support area of our site are classed as an existing offer in the store. Promotional codes are created for use in our store only.
Returns
If, for any reason, you change your mind and would like to return your order after delivery, we are happy to offer you a refund or exchange provided your item is unopened and in the original packaging. This option is available for twenty one days after you receive your order.
In compliance with Distance Selling Regulations, we will accept returned items even if you have opened the goods to inspect them. You are entitled to a refund provided you notify us within seven working days* of the day after delivery. The goods must in an ‘as new’ condition and returned in the original, undamaged packaging, along with any accessories and free gifts received with your order. Whilst the goods are in your possession you must take reasonable care of them and not use them. DVDs, CDs, memory cards and software must still be sealed.
*'working days’ means all days other than Saturday, Sunday and public holidays. To exercise this right you need to contact us within the seven working day period on 0844 553 2321 or email contact.shop@fujifilm.co.uk
We will provide a full refund for the cost of the product plus the delivery charge paid (from original order). Refunds will be credited to your payment card within twenty one working days.
We do not cover the postage costs for returning the goods to us.
Damaged Goods
What happens if my product arrives damaged?
On rare occasions, a product may get damaged in transit. If you do receive a damaged product, please call us within 48 hours on 0844 553 2321 and we will send a pre-paid bag to enable you to return your order to us at no cost to you. We will then either refund the cost of the product plus the delivery charge paid (from original order) or replace your product(s).
Faulty Goods
What happens if my item is faulty?
If the fault happens within twenty one days of the date of delivery, you have the option of either a refund or an exchange. After twenty one days the item would be covered by the one year manufacturer’s warranty period and will be repaired.
Please note that we may ask to inspect the goods to confirm any fault before a refund or an exchange is processed
If the fault occurs within twenty one working days, please call us on 0844 553 2321 and we will send a pre-paid bag to enable you to return your order to us at no cost to you.
Price Protection
If the price of an item you buy in "the store" is lowered within seven (7) days of the date of your purchase, we will honour the new price and credit the difference. To obtain your credit, please send an email to contact.shop@fujifilm.co.uk, including your name, address and order number.
Please note:
- Requests for price adjustments must be made within thirty (30) days of the date of purchase.
- We will honour only one price adjustment per item.
- Products purchased using a promotion code are not eligible for price adjustments.
Warranty
All products are covered by our normal 12 month warranty.
Limitation of Liability
(a) Subject to paragraph (c) below, if we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the product and, subject to paragraph (b) below, any losses that you suffer as a result of our failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure.
(b) Subject to paragraph (b) below we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
(i) loss of income or revenue;
(ii) loss of business;
(iii) loss of profits;
(iv) loss of anticipated savings;
(v) loss of data; or
(vi) waste of management or office time.
However, this paragraph (b) will not prevent claims for loss of or damage to your tangible property that are foreseeable or any other claims for direct loss that are not excluded by categories (i) to (vi) inclusive of this paragraph (b).
(c) Nothing in these terms and conditions excludes or limits our liability for:
(i) death or personal injury caused by our negligence;
(ii) fraud or fraudulent misrepresentation;
(iii) any breach of the obligations implied by section 12 of the Sale of Goods Act 1979;
(iv) defective products under the Consumer Protection Act 1987; or
(v) any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
Protection of Personal Data
You agree that any personally identifiable information you provide to us in connection with "the store" may be dealt with by us in accordance with the terms specified in the FUJIFILM UK Limited ( shop.fujifilm.co.uk /privacy-policy) Privacy Policy available via the link at the bottom of the (shop.fujifilm.co.uk) web site.
Written communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using "the store", you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
Notices
Save as otherwise provided in these terms and conditions, all notices given by you to us must be given to FUJIFILM UK Limited at the address set out at the end of these terms and conditions [or by e-mail to contact.shop@fujifilm.co.uk]. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in the Written Communications paragraph above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
Waiver
If we fail, at any time during the term of our contract with you, to insist upon strict performance of any of your obligations under such contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under such contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with the Notices paragraph above.
Severability
If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any contract with you that is caused by events outside our reasonable control (a “Force Majeure Event”) including, without limitation, fire, flood, explosion, storm, earthquake, war, terrorism, sabotage, revolution, riot or civil commotion, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, strikes, lockouts, failure of supplies of public or private telecommunications networks, power or fuel or the default of suppliers or sub-contractors. Our performance under our contract with you is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under such contract may be performed despite the Force Majeure Event.
Entire agreement
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of our contract with you. While we accept responsibility for statements and representations made by our duly authorised representatives, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
Law and jurisdiction
Contracts for the purchase of products through "the store" and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales
